“#shecanfund” Campaign

(Terms and Conditions)

 

  1. Information on how to enter the “#shecanfund” campaign (Campaign) form part of these Terms and Conditions. By participating in the Campaign you accept these Terms and Conditions.

     

  2. The Promoter is Kimberly-Clark Australia Pty Limited, 52 Alfred Street Milsons Point NSW 2061, ABN 65 000 032 333, Tel: 1800 028 334

     

  3. Voting is only open to Australian residents who are aged 13 years or over (Participant). Employees of agencies associated with this Campaign are ineligible to enter.

     

  4. Voting opens at 12:01am (AEDT) on 01/03/2020 and close at 11:59pm (AEDT) on 31/03/2020. This is stated as the Campaign Period.

     

    How to submit a vote:

     

  5. To submit a vote in the Campaign, Participants must, during the Campaign Period:

     

    1. locate one of the two Campaign Snapcodes, at:

      5.  on in-store campaign assets at participating Coles stores.

    2. scan 1 of the 2 Snapcodes (above) to access the #shecanfund Snapchat Filters (Note: Participants scanning a Coles #shecanfund Snapcode may submit a second vote if they follow the additional steps set out below).

       

    3. choose 1 of the 3 #shecanfund initiatives through the Snapchat application that the Participant wishes to submit a vote for:

       

      1. Mental Health - Top Livin Limited ACN 600 787 513 - www.livin.org

      (each, a “Cause”);

       

    5. within an hour of accessing the Snapchat lens, take a photo or record a video through the Snapchat Application (using the Filter indicated for the Cause they want to support) explaining why they think the Cause is important and needs the Promoter’s support;

       

    6. send their photo or video to @ubykotexaunz on Snapchat to submit their vote for the initiative of their choice (noting this must be done within an hour of accessing the Snapchat lens); and

       

    7. accept these Campaign Terms and Conditions,

       

  6. (“Vote”).

     

  7. Limit of one Vote per person unless a Participant has a Coles #shecanfund SnapCode and complies with clause 7 below (in which case Participant can submit a second Vote).

     

  8. Additional steps to submit second vote using Coles #shecanfund Snapcode:

     

  9. Participants with a Coles #shecanfund Snapcode who are wishing to submit an additional Vote in the Campaign, must, during the Campaign Period after completing steps a) – f) above to submit one Vote:

     

    1. submit proof of purchase in the form of a photograph of Coles receipt clearly displaying purchase of at least 1 x U by Kotex product during the Campaign Period; then

       

    2. complete steps c) – f) above to submit their extra Vote.

       

  10. Determination of allocation of Donation between Causes

     

  11. The Promoter will donate to each Cause an allocation of $50,000AUD (Donation) that represents the percentage of total Votes that each Cause received through this Campaign (noting the equivalent percentage of the Donation will be rounded to the nearest $100 dollars).

     

  12. The Votes and percentages will be calculated by Mish Guru Limited NZBN – 9429041293614, 101 Pakenham St W, Auckland, 1010, New Zealand.

     

  13. The Promoter will announce the final allocation of the Donation to each Cause on 14/04/2020 AEDT, by posting on www.UbyKotex.com.au/SheCanFund.

     

  14. The Participant accepts that no part of the Donation will be distributed to any individual Participant and accepts that the Donation is not a prize for entry into this Campaign.

     

  15. The Promoter reserves the right, at any time, to verify the validity of Votes and Participants’ details and to disqualify any Participant who submits an Vote that is not in accordance with these Terms and Conditions or who tampers with the entry process.Incomplete, indecipherable or illegible Votes will be invalid.

     

  16. By submitting a Vote in this Campaign, the Participant declares that their Vote is their own original work and not copied in whole or in part from any other person, and that the Vote does not infringe the intellectual property rights of any third party.

     

  17. By submitting an entry in this Campaign, the Participant grants the Promoter and its affiliates, agents and representatives an exclusive, royalty-free, perpetual, irrevocable, transferable, worldwide licence to use, edit, reproduce and exploit their Vote by all means whatsoever (including, without limitation, in print and electronic format) for any purpose.In addition, the Participant consents to the Promoter and the Promoter's affiliates, agents or representatives infringing the Participant's moral rights in their Vote.The Participant waives any right to inspect or approve any use, edit or reproduction by or on behalf of the Promoter of all or any part of the Participant's Vote.

     

  18. If this Campaign is interfered with in any way or is not capable of being conducted as reasonably anticipated for any reason, the Promoter reserves the right, at its sole discretion: (a) to disqualify any Participant who the Promoter suspects has tampered with the Vote process; or (b) to modify, suspend, terminate or cancel the Campaign, as appropriate; (c) to amend the way it allocates the Donation between the Causes from what is set out in these Terms and Conditions.

     

  19. If any act or omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations and the Promoter reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend the Campaign.

     

  20. The www.UbyKotex.com.au/SheCanFund webpage, Snapchat Application and Snapchat Filters may not be available for access from time to time during the Campaign Period. All access to, and use of, the www.UbyKotex.com.au/SheCanFund webpage, Snapchat Applicationand Snapchat Filters is at the individual’s expense and risk. The Promoter has no control over internet, the Snapchat Application or mobile telecommunications, network lines, bugs, viruses and server problems and accepts no responsibility for any problems associated with them, for whatever reason.

     

  21. The Promoter will collect and store all personal information of Participants and winners in accordance with all applicable laws of Australia as well as its privacy policy, available at https://www.kimberly-clark.com.au/en/others/privacy/.

     

  22. Participants consent to the Promoter using their name, likeness, image and voice (including photograph, film and recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Campaign (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

     

  23. The Campaign is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram or Snapchat (Snap Inc). Any questions, comments or complaints about this Campaign must be directed to the Promoter and not to Facebook, Instagram or Snap Inc. Each Participant completely releases Snap Inc., Facebook and Instagram from all claims based on, related to or arising from the Campaign.
